1. Acceptance of Terms

By accessing or using ClassQuest™ ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not use our Service.

These Terms apply to all users, including teachers, students, parents, and administrators.

2. User Accounts

2.1 Teacher Accounts

Teachers must provide accurate information and maintain account security. Teachers are responsible for all activities under their account and must:

• Be 18 years or older
• Have authorization to use ClassQuest in their educational setting
• Comply with FERPA and other applicable privacy laws
• Obtain necessary parental/school consent before creating student accounts
• Use the Service only for legitimate educational purposes

2.2 Student Accounts

Student accounts may be created by teachers or by students with teacher authorization. Students must:

• Have parent/guardian consent if under 13 (via school or teacher)
• Use the Service only as directed by their teacher
• Follow all classroom rules and acceptable use policies
• Respect other students and maintain a positive environment

3. Acceptable Use Policy

You agree NOT to:

• Use the Service for any illegal or unauthorized purpose
• Violate any laws, regulations, or third-party rights
• Harass, bully, or harm other users
• Share inappropriate, offensive, or harmful content
• Attempt to gain unauthorized access to other accounts or systems
• Interfere with or disrupt the Service or servers
• Use automated means to access the Service (bots, scrapers)
• Reverse engineer, decompile, or attempt to extract source code
• Remove or modify any copyright, trademark, or proprietary notices
• Share student data with unauthorized third parties

4. Subscriptions and Payments

4.1 Free Trial

ClassQuest offers a 7-day free trial. No credit card is required. The trial automatically expires unless you subscribe to a paid plan.

4.2 Paid Subscriptions

• Silver Plan: Basic features for individual teachers
• Gold Plan: Advanced features including boss battles and custom content

Subscriptions are billed monthly or annually. All fees are non-refundable except as required by law.

4.3 Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. Access continues until that date.

5. Intellectual Property

5.1 ClassQuest Ownership

ClassQuest™ and all related content, features, and functionality are owned by ClassQuest and protected by copyright, trademark, and other intellectual property laws.

5.2 User Content

Teachers retain ownership of custom content they create (challenges, abilities, items). By using ClassQuest, you grant us a license to store, display, and process this content to provide the Service.

5.3 Student Data

All student data remains the property of the student, parent, or school. ClassQuest claims no ownership rights to student educational records.

6. Educational Use Only

ClassQuest is designed exclusively for educational purposes in K-12 classrooms and similar educational settings. Commercial use, resale, or use outside of educational contexts requires prior written authorization.

7. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. ClassQuest does not guarantee:

• Uninterrupted or error-free operation
• Specific educational outcomes or behavior improvements
• Compatibility with all devices or browsers
• Complete data security (though we implement industry-standard protections)

8. Limitation of Liability

To the maximum extent permitted by law, ClassQuest shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the past 12 months.

9. Termination

We may suspend or terminate your access to the Service for:

• Violation of these Terms
• Fraudulent or illegal activity
• Non-payment of subscription fees
• Harm to other users or the Service

Upon termination, your right to use the Service ceases immediately. Student data will be retained for 30 days to allow export, then permanently deleted.

10. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email at least 30 days in advance. Continued use after changes take effect constitutes acceptance of the modified Terms.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration or in the courts of the applicable jurisdiction.
